1. Agreement to Terms

By accessing or using SENScribe, you agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these terms, you must not use SENScribe.

These terms form a legally binding agreement between you and SENScribe Limited("we", "us", "our"), a company registered in Ireland (CRO: 813862), with registered address at ARKINS & COMPANY LIMITED, BLOCK 15, Galway Technology Park, Parkmore, Galway, GALWAY, Ireland, H91 AY0Y.

2. About SENScribe

SENScribe is an AI-powered tool that helps Irish primary and post-primary school teachers create draft Student Support Plans aligned with the Department of Education's Continuum of Support framework.

What SENScribe Does

• Generates draft Student Support Plan content using AI
• Provides suggested language aligned with Department of Education guidance
• Helps structure support documentation

What SENScribe Does NOT Do

• Replace professional educational judgement
• Provide medical, psychological, or legal advice
• Guarantee compliance with any specific requirements
• Store plaintext copies of your documents (all saved data is encrypted end-to-end on your device before storage)
• Receive or process student names (they are redacted in your browser before transmission)

3. Who Can Use SENScribe

To use SENScribe, you must:

• Be at least 18 years old
• Be a teacher or educational professional working in Ireland
• Have a valid email address

By creating an account, you confirm that you meet these requirements.

4. Your Account

Account Security

We use email and password authentication. Passwords are securely hashed using scrypt and never stored in plaintext. You are responsible for:

• Keeping your email account and password secure
• Using a strong, unique password
• Not sharing your login credentials with others
• Notifying us immediately if you suspect unauthorised access

Account Deletion

Your account data is automatically deleted after 12 months of inactivity. You can also request deletion at any time by contacting us.

5. Acceptable Use

You agree to use SENScribe only for its intended purpose: generating draft Student Support Plans for legitimate educational purposes.

Prohibited Activities

You must not:

• Use SENScribe to generate content unrelated to student support
• Enter false, fabricated, or misleading student information
• Attempt to manipulate the AI to produce inappropriate, discriminatory, or harmful content
• Share your account access with others or allow unauthorised use
• Use automated tools, bots, or scripts to access the service
• Attempt to reverse-engineer, copy, decompile, or replicate the service
• Circumvent security measures or attempt to gain unauthorised access
• Use the service in any way that violates applicable laws or regulations
• Upload malicious code, viruses, or harmful content

Content Standards

All content you generate or input must:

• Be used for legitimate educational purposes only
• Be accurate and truthful to the best of your knowledge
• Respect student privacy and dignity
• Not contain discriminatory, defamatory, or offensive material
• Comply with your school's policies and professional standards

Fair Use Limits

Free trial users receive 14 days of unlimited access. Paid plans (Teacher, School) provide ongoing unlimited access. We may adjust these limits as needed.

Enforcement

If you breach these acceptable use rules, we may:

• Issue a warning
• Temporarily suspend your access
• Permanently terminate your account
• Report serious violations to relevant authorities

The action we take depends on the severity and nature of the breach.

6. AI-Generated Content

You Acknowledge That

• AI-generated content may contain errors or inaccuracies
• The AI does not have knowledge of individual students
• Outputs are suggestions, not professional advice
• You are solely responsible for reviewing and approving any content before use
• We do not guarantee that outputs will meet specific regulatory requirements

Your Professional Responsibility

As an education professional, you retain full responsibility for any documents you create using SENScribe. The AI assists your work but does not replace your professional judgement.

7. Student Data Responsibilities

When you use SENScribe, you may enter information about students. You acknowledge and agree that:

• Your School, Education and Training Board (ETB), or Board of Management is the data controller for any student personal data entered into or processed through the Services in an Irish educational setting
• You are acting only as an authorised user of that School, ETB, or Board of Management, and you process student personal data solely on their behalf and under their authority
• You will comply with your school's instructions and policies and process student personal data only in accordance with applicable law
• You have obtained and will maintain the necessary internal authorisation from your School, ETB, or Board of Management to use SENScribe for processing student information
• You will use only the minimum necessary information to generate appropriate outputs
• Student data is encrypted end-to-end on your device before being stored on our servers - we cannot decrypt or read your data
• Specific diagnoses are generalised- conditions like "ADHD" are replaced with functional descriptions like "attention regulation needs" before transmission
• For AI generation, student names are redacted and diagnoses are generalised in your browser before transmission - the AI never sees identifiable data

8. Intellectual Property

Our Intellectual Property

SENScribe, including its design, features, code, and branding, is owned by SENScribe Limited. You may not copy, modify, distribute, or create derivative works based on SENScribe without our written permission.

Your Content

You retain ownership of any original information you input into SENScribe. The AI-generated outputs are provided for your use and you may use them as you see fit for their intended educational purpose.

9. Service Availability

We aim to provide reliable access to SENScribe, but we do not guarantee uninterrupted service.

• The service may be unavailable for maintenance or updates
• Third-party services we depend on may experience outages
• We may modify, suspend, or discontinue features with reasonable notice

We will try to give reasonable notice of any significant changes or planned downtime.

Updates

We will provide security updates necessary to keep SENScribe functioning securely for the duration of your access. Where updates are available, we will notify you and make them available promptly.

10. Limitation of Liability

To the maximum extent permitted by Irish and EU law:

We Are Not Liable For

• Any errors or inaccuracies in AI-generated content
• Decisions you make based on AI-generated outputs
• Loss of data or service interruptions
• Any indirect, incidental, or consequential damages

Important Exceptions

Nothing in these terms limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded under Irish or EU law

Maximum Liability

Where we are liable, our total liability to you for any claims arising from your use of SENScribe is limited to the amount you paid us in the 12 months before the claim arose, or €100, whichever is greater.

11. Indemnification

You agree to compensate SENScribe Limited for any losses arising directly from:

• Your breach of these Terms of Service
• Your misuse of SENScribe
• Your violation of any applicable laws
• Claims related to student data you input into the service

This indemnity is limited to losses that are a reasonably foreseeable consequence of your actions. Nothing in this section requires you to compensate us for losses caused by our own negligence or breach.

12. Termination

By You

You may stop using SENScribe at any time. Your account will be automatically deleted after 12 months of inactivity. You can also request immediate deletion by contacting us.

By Us

We may suspend or terminate your access if you:

• Breach these Terms of Service
• Use the service in a way that could harm us or other users
• Engage in fraudulent or illegal activity

We will try to give you notice before termination unless immediate action is required.

Your Rights Under Irish Consumer Law

If SENScribe does not work as described and we cannot fix the issue within a reasonable time, you are entitled to a proportionate refund under the Consumer Rights Act 2022. To request a remedy or refund, contact us at hello@senscribe.ie.

Nothing in these terms affects your statutory rights as a consumer under Irish or EU law.

Right of Withdrawal

Under EU distance selling rules, you normally have 14 days to withdraw from a purchase. However, when you purchase a SENScribe plan (Teacher or School) and agree to receive immediate access to the digital service, you acknowledge that you lose your right of withdrawal once access is provided. You will be asked to confirm this before completing your purchase.

13. Changes to Terms

We may update these Terms of Service from time to time. When we make material changes:

• We will update the "Last updated" date at the top
• We will notify registered users by email
• We will give at least 14 days notice before changes take effect

By continuing to use SENScribe after changes take effect, you accept the updated terms.

14. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Ireland.

Any disputes arising from these terms or your use of SENScribe will be subject to the exclusive jurisdiction of the courts of Ireland.

If you are a consumer in the European Union, you also have the right to bring proceedings in your country of residence. Nothing in these terms affects your statutory rights as a consumer under Irish or EU law.

Severability

If any part of these terms is found to be unenforceable, the remaining parts will continue to apply.

Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and SENScribe Limited regarding your use of SENScribe.
